AtlayoNET Terms of Service

These AtlayoNET Terms govern registration of names in the AtlayoNET namespace, use of the domain portal, the tunnel agent, certificates, and visits made through the Atlayo Browser. They are the contract for AtlayoNET as a separate service from the Atlayo chat app. If you do not agree, do not register a name or run the tunnel agent. If a translation differs from the English text, the English text is authoritative.
1. Parties and other terms
1.1 These Terms are a contract between you (“you” or “Registrant”) and Atlayo Overseas s.r.o., company ID 29645433, VAT ID CZ29645433, registered in the Commercial Register kept by the Regional Court in Brno, file C 152275, with registered office at Příkop 843/4, Zábrdovice, 602 00 Brno, Czech Republic (“Atlayo”, “we”, “us”). The parent company of the Atlayo group is Atlayo spol. s r.o.
1.2 AtlayoNET is a separate service from the Atlayo super-app. These Terms apply together with the AtlayoNET Privacy Policy and the AtlayoNET Acceptable Use Policy. If you are in the EU/EEA, the EU / EEA Jurisdiction Addendum also applies to personal-data processing. Using an Atlayo ID to sign in does not make the app Terms of Service the contract for AtlayoNET names, tunnels or certificates. Mandatory consumer law always prevails.
1.3 By creating an AtlayoNET registration, paying a fee, pairing a tunnel agent, issuing a certificate, or using AtlayoNET through the Atlayo Browser, you accept these Terms.
2. What AtlayoNET is
2.1 AtlayoNET is a private naming and reachability service operated by Atlayo. It lets you register a name in Atlayo’s own namespace and, if you run the tunnel agent, make an origin you control reachable through Atlayo’s gateways when a visitor uses the Atlayo Browser.
2.2 AtlayoNET is not the public internet, public DNS, or an ICANN-accredited domain registration. A name on AtlayoNET does not give you rights in the corresponding name on the public web, and a public-web registration does not give you rights in AtlayoNET. Other browsers (for example Chrome, Safari, Firefox or Edge using public DNS) will not resolve AtlayoNET names.
2.3 Names are looked up only inside Atlayo’s network (including DNS-over-HTTPS used by the Atlayo Browser). Routing uses the requested hostname to send the visit to a gateway, then to your paired agent, then to the origin you configure (typically on your own machine).
2.4 You do not acquire ownership of a top-level label, of the AtlayoNET namespace, or of Atlayo’s infrastructure. Registration is a limited, revocable licence to use a specific name in AtlayoNET for the paid term, subject to these Terms.
3. Availability
3.1 AtlayoNET may be offered as coming soon, in beta, or with limited capacity. We do not guarantee a launch date, uninterrupted service, or that a particular name, TLD-style ending, gateway region or feature will remain available.
3.2 We may change technical requirements (supported operating systems, agent versions, certificate formats, pairing methods) where reasonably needed for security or operation. Where a change materially affects your rights, we will notify you in the portal, in the app, or by email where appropriate.
3.3 AtlayoNET is provided on a reasonable-efforts basis. There is no service-level agreement unless we agree one in a separate written contract.
4. Eligibility and Atlayo ID
4.1 You must have a valid Atlayo ID and capacity to contract. If you act for an organisation, you warrant that you are authorised to bind it.
4.2 You must be 16 or older in the EU/EEA, or have valid parental consent where required. You must not register AtlayoNET names for a child in a way that publishes the child’s personal data in WHOIS or on a hosted origin.
4.3 Registration is performed at the domain portal (currently domains.atlayo.com) after you authenticate with Atlayo ID. You must keep login credentials, pairing tokens and agent keys confidential.
5. Names and the registry
5.1 A registrable name is a full name including an ending we offer
(for example a label plus .net). Availability is determined solely by the
AtlayoNET registry, on a first-come, first-served basis, subject to reserved names and
the Acceptable Use Policy.
5.2 We may reserve, refuse or reclaim names that are identical or confusingly similar to Atlayo brands, that impersonate public bodies, that are used for phishing or fraud, or that we are required to withhold by law. Parallel-namespace availability is not a licence to impersonate a well-known public-web brand in a way that deceives visitors.
5.3 You are responsible for choosing a lawful name. Registration does not mean we have cleared trade marks, personality rights, or other third-party rights.
5.4 You must provide accurate registrant information and keep it updated. False identity or payment details are grounds for suspension or deletion.
6. Fees, payment and withdrawal
6.1 The standard registration fee is the price shown at checkout (currently USD 5 per name per year, or the equivalent we display). Taxes (including VAT) may be added where required. Prices may change for future terms; the price you pay for a given term is the price confirmed at checkout for that term.
6.2 Payment is processed by Stripe (or another processor we name at checkout). We do not store full payment-card numbers. Stripe’s terms and privacy notice also apply to the payment.
6.3 Fees are charged in advance for the registration term. Renewal is not automatic unless we clearly offer auto-renewal and you enable it.
6.4 If you are a consumer in the EU/EEA, you may have a 14-day right of withdrawal from a distance contract for digital services. If you ask us to start registration immediately (allocating the name in the registry), you acknowledge that you may lose that withdrawal right once performance has begun, to the extent Directive 2011/83/EU and Czech implementing law allow. We will present the required consent language at checkout when that applies.
6.5 Except where mandatory consumer law requires otherwise, fees are non-refundable after a name is allocated, including if you stop using the tunnel, fail to pair within 90 days, or the name is later deleted for inactivity or breach.
7. Tunnel agent and origin hosting
7.1 To make a name reachable, you install and run Atlayo’s tunnel agent (or a compatible official client) on a machine you control. The agent pairs with Atlayo’s authority using a pairing key and token, then maintains a session (typically QUIC) to a gateway. You do not need a public IP address or inbound router ports for this model.
7.2 The origin (your website or service) stays on your machine or on infrastructure you choose. Atlayo relays connections; we do not host your site files on the gateway as a general web host, and we do not promise to store or back up your origin content.
7.3 You must configure the origin safely (TLS on the origin as required, access control, patching). You are responsible for what the origin serves, including to visitors who reach it through AtlayoNET.
7.4 You must not attack, overload or reverse-engineer the authority, gateways or pairing protocol, or share pairing credentials. You must keep the agent reasonably up to date.
7.5 If the agent is offline, the name will not resolve to a live origin. That is expected behaviour, not a defect, unless we have agreed otherwise in writing.
8. Certificates
8.1 You may generate a TLS certificate for your AtlayoNET name from the portal, issued by Atlayo’s organisational certificate authority. The certificate is intended for the Atlayo Browser and AtlayoNET routing. Public browsers and public CAs will not, and should not, treat it as a publicly trusted web certificate.
8.2 You must protect private keys, use certificates only for names you registered, and stop using a certificate if the name is deleted or transferred (if we later allow transfer). We may revoke certificates for abuse, expiry, or security incidents.
9. Paid term and 90-day pairing
9.1 A paid registration has an expiry date for the licence term. When the term ends without renewal, we may delete the name from the registry.
9.2 Independently of the paid term, if the tunnel agent does not complete a successful pairing with the authority for 90 consecutive days, we may delete the name from the registry. Pairing while the agent is running (including periodic re-pairing) counts as activity. Mere payment without pairing does not prevent this deletion.
9.3 After deletion, the name may be registered by someone else. We are not obliged to restore a deleted name, refund fees, or notify you beyond what we reasonably display in the portal.
10. WHOIS
10.1 We may publish a WHOIS-style record for registered names, which can include the name, registration and expiry information, pairing status, and limited registrant identifiers (for example a display name or transaction reference). See the AtlayoNET Privacy Policy.
10.2 WHOIS is provided for transparency and abuse handling, not as a public-internet WHOIS under ICANN rules.
11. Acceptable use
11.1 You must comply with the AtlayoNET Acceptable Use Policy.
11.2 You must not use AtlayoNET for illegal activity, child sexual abuse material, malware, botnets, phishing, unsolicited bulk abuse, or to attack Atlayo or others. We may remove names, revoke certificates, drop tunnel sessions and report to authorities where required or to prevent serious harm.
12. Your content and our role
12.1 You retain rights in content on your origin. You grant Atlayo a limited licence to transmit, route and cache technically necessary fragments of traffic solely to operate AtlayoNET.
12.2 For Digital Services Act purposes, AtlayoNET routing is generally a mere conduit / caching transmission of communications between the visitor and your origin. The registry is a naming directory. We are not the publisher of your origin. This does not limit our right to act on illegal names, illegal use of the tunnel, or valid orders.
12.3 Notices about illegal names or illegal content reachable via AtlayoNET: legal@atlayo.com (and lawenforcement@atlayo.com for authorities).
13. Intellectual property
13.1 Atlayo, AtlayoNET, the Atlayo Browser, the tunnel agent, the portal, the namespace, and related software and trade marks remain our property or that of our licensors. These Terms do not transfer them.
13.2 Feedback you send may be used by us without obligation to you.
14. Suspension, deletion and refunds
14.1 We may suspend a name, pairing, certificate or portal access if you breach these Terms, if required by law, if fees fail, or if continued operation would create risk to users, children, or the platform.
14.2 You may stop using AtlayoNET at any time. Deleting a name in the portal (when offered) ends the licence for that name. Account deletion under the main Service may also remove AtlayoNET registrations linked to that Atlayo ID.
14.3 Refunds are as in section 6. Mandatory consumer remedies remain unaffected.
15. Liability and disclaimers
15.1 AtlayoNET is provided “as is” and “as available”, except where mandatory law requires otherwise. We do not warrant that a name will remain unique outside AtlayoNET, that public browsers will open it, that your home origin will stay online, or that third parties will not register a similar public-web domain.
15.2 You are responsible for visitors’ experience on your origin, including cookies, payments, and any personal data you collect there. You are the controller of that origin processing unless another controller is identified.
15.3 Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or other liability that cannot be limited under Czech or applicable EU law.
15.4 Subject to section 15.3, we are not liable for indirect, incidental, special or consequential damages, loss of profits, data, goodwill, or loss of a name after inactivity deletion, except where mandatory consumer law provides otherwise.
15.5 If you are a consumer in the EU/EEA, you benefit from mandatory consumer-protection rights in your country of residence.
16. Changes
16.1 We may update these Terms. The updated version will be posted on this page with a new “Last updated” date. Material changes will be notified in the portal or by email where appropriate. Continued use after the effective date constitutes acceptance, except where mandatory law requires a different process.
17. Governing law and disputes
17.1 These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-law rules.
17.2 If you are a consumer in the EU/EEA, you may also bring claims in the courts of your country of residence. You may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
17.3 We are not obliged to participate in alternative dispute-resolution proceedings before a consumer arbitration board, but we will consider reasonable requests.
