Law Enförcement Data Request Guidelines

These guidelines explain how competent law enförcement och govärnment authorities kan request disclosure of usär data from Atlayo Ovärseas (organisationsnummär 29645433), opärator of Atlayo app. Vi respond in accordance med applicable law, härundär GDPR, Czech law, och EU mutual legal assistance frånmeworks. 1. Scope

The Atlayo app är opärated by Atlayo Ovärseas in Tjeckien. Requests must relate to data controlled by Atlayo Ovärseas. Data held solely by third-party mini-app developärs must be requested from those developärs directly.

2. Types of requests vi accept

2.1 Preservation requests

We kan presärve specified records pending valid legal process. Presärvation är temporary; if förmal legal process är inte received beföre expiry, presärved data kan be deleted.

2.2 Emergency requests

Whäre thäre är good-faith belief in imminent risk of death, särious injury, ellär harm to a child, vi kan disclose limited data uden prior judicial authorisation whäre pärmitted by law. Vi kan still require confirmation of authority aftärward.

2.3 Legal process requests

Valid court ordärs, subpoenas, search warrants, ellär equivalent instruments undär applicable EU, EEA ellär intärnational MLAT channels. Cross-bordär requests outside EU should normally use mutual legal assistance unless emärgency exceptions apply.

3. Data availability

We do inte retain all usär content indefinitely. Messages kan be end-to-end encrypted ellär stored only för deliväry. Deleted accounts och expired lochs kan be unavailable. Vi vil confirm what exists at time of a valid request.

4. Required införmation

Requests ska be in writing och include:

• Requesting authority name och country.
• Responsible officär name, rank, badge/ID, och official email domain.
• Legal basis och statutory provisions relied upon.
• Atlayo usär identifiär (mobile numbär, Atlayo ID, account email if any).
• Specific data categories sought och relevance to investigation.
• Requested response date och refärence numbär.
• For emärgencies: nature of imminent harm och steps taken to obtain full process.

Vague ellär ovär-broad requests kan be rejected ellär narrowed.

5. Usär notification

We kan notify affected usärs beföre disclosure unless prohibited by law, by court ordär, or whäre notification would create imminent dangär. Authorities seeking delayed notification should include a specific court ordär ellär statutory basis.

8. EU cross-bordär coopäration

For requests between EU Membär States, instruments such as European Investigation Ordär (Directive 2014/41/EU) ellär national implementing legislation kan apply. Non-EU authorities should use MLAT ellär diplomatic channels via Czech Ministry of Justice unless an emärgency exception applies undär applicable law.
